Rules for the Valentine's Day competition 2024
Conditions for the competition (“Competition”) entitled:
"Valentine's Day Contest".
§1 Organizer
The organizer of the competition (hereinafter referred to as the "Competition") is Jobo Europe Spółka z ograniczoną odpowiedzialnością with its registered office in Sokołów, ul. Gromadzka 5, registered in the business register of the National Court Register maintained by the District Court for the City of Warsaw, XIV. Economic Department of the National Court Register will, under the number: 0000803371, REGON: 38368971400000, NIP: 534 260 29 28. Share capital: PLN 3000000.
(hereinafter: “Organizer”).
§2 Participants of the competition
A participant in the competition (hereinafter referred to as a “participant”) can only be a natural person with full legal capacity who has his or her place of residence in the territory of the Republic of Germany and who has the following
1. constant internet access (a device with internet access (computer, tablet, telephone, etc.),
2. a standard web browser with cookie support,
3. a personal Facebook/Instagram account.
Employees of the organizer and their family members, i.e. relatives in the ascending and descending line, siblings, spouses, parents of spouses and people who are in an adoption relationship are excluded from participating in the competition.
§3 Rules of the competition
Participation in the competition is voluntary. 2.
2. Participation in the competition is subject to the following conditions:

4. he/she has read the competition rules and accepts the terms and conditions contained therein,
5. the participant agrees to the processing of his or her personal data for participation in the competition,
6. the fulfillment of the competition task mentioned in §3 [Wettbewerbsregeln].
7. Consent to the processing of data for the purpose of participating in the competition can be expressed in particular through the participant's active participation in the competition.

8. The competition runs from February 2nd, 2024 to February 16th, 2024.
9. Competition tasks that are completed after the competition deadline cannot be taken into account.
10. The competition is carried out via the organizer's fan page called JOBOBIKE on Facebook and the organizer's fan page called jobobike_de. The organizer's fan page called jobobike_de on the social network Instagram.

The task of the competition is to like the competition post and leave a comment under the competition post on the organizer's fan page on Facebook or on the organizer's fan page on the social network Instagram, in which the participant fulfills the tasks:
"1. Follow @Jobobike DE. 2. Like this post. 3. a written comment with the answer to the question: "Where would you take your better half with a Jobobike electric bike?".
(1) A participant can only take part in the entire competition once.
By participating in the competition, the participant confirms that he/she is aware that winning the prize does not depend on chance, but on the participant's actions, i.e. on fulfilling the competition conditions and completing the competition task as well as on winning the competition.
3 The organizer reserves the right to remove texts or photos that are generally considered offensive, violating the rights of third parties or the law, commercial offers, pornographic content, hurting religious feelings or violating the personal rights of others.
4 In the event of a violation of the above conditions, the organizer reserves the right to exclude the participant from the competition.
5 The winner of the competition will only be selected by the organizer from those who meet the requirements set out in the conditions of participation.
6 By taking part in the competition, the participant accepts the conditions of the competition stated in the terms and conditions of participation.
§4 Prices
(1) The organizer appoints a three-member competition committee that monitors the proper conduct of the competition and the selection of the 9 winners.

(2) The organizer selects the most creative competition answers that fulfill the tasks of the competition.
(3) The prize in the competition is 3 vouchers that can be used on the website www.jobobike.de.
1 voucher 50 euros - 1 person
1 voucher 25 euros - 3 people
1 voucher 10 euros - 5 people
(4) The results of the competition (first and last name of the winners) will be published on the organizer's fan page after the end of the competition, i.e. on February 19, 2023.
(5) The winner is obliged to send a private message with his contact details and the address for sending the prize via Facebook Messenger or Instagram.
(6) The winner cannot transfer the claim to the prize to a third party.
(7) The prize cannot be exchanged for cash or for other products.
(8) In order to receive the prize, the participant must provide their name and email address.
(9) The prize will only be sent via email.
§5 [Complaints].
(1) The participant in the competition has the right to lodge complaints regarding the competition
within 14 days of the end of the competition. 2.
(2) Written complaints must be sent to the address of the organizer’s registered office.
(3) The date of the postmark is decisive for compliance with the complaint deadline.
(4) The complaint should contain the participant's data: first and last name, correspondence address or email address and the reason for the complaint.
(5) The organizer will examine the complaints within 14 days of their receipt.
(6) The participant will be notified of the organizer's review of the complaint by post to the address stated in the complaint.
§6 [Copyright].
(1) By taking part in the competition, the participant declares that their competition work, i.e. the answer to the competition question, comes exclusively from them and does not infringe any copyright or property rights of third parties.
(2) The participant bears full responsibility for any claims by third parties in relation to the competition work submitted by him.
(3) The participant transfers to the organizer all copyrights to which the organizer is entitled in the work that he submits for participation in the competition.
(4) The organizer reserves the right to use and publish the competition works submitted by the participants without any time or territorial restrictions and in all areas of use listed in Article 50 of the Law of February 4, 1994 on copyright and related rights to use separate publication.

§7 [Personal Data - RODO.]
(1) The organizer is the administrator of the participants’ personal data.
(2) The processing of participants' personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons
relating to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (hereinafter: RODO).
(3) The processing of the participant's data is based on the participant's voluntary consent, which he or she gave for the purpose of participating in the competition.
(4) The organizer processes the participant's data, such as his first and last name, his home address and his contact telephone number, in order to be able to take part in the competition.
(5) In order to deliver and bill the prize, the organizer is entitled to process the winner's data, such as: first and last name, email address and telephone number.
(6) The participant has the right to access the content of his data, to correct it, to restrict its processing and to object to the processing of personal data for marketing purposes or to its transfer to another data controller.
(7) The participant has the right to data portability if the processing is carried out automatically, as well as the right to be forgotten (deletion of the data), unless provisions of other laws require the organizer to retain the data for a certain period of time.
(8) Personal data is collected directly from the person to whom it relates.
(10) The participant can change his decision at any time and withdraw his consent to the processing of his personal data. Such a decision means that he would like to withdraw from the competition. The participant can revoke his consent at any time by notifying the organizer.
(11) The participant's personal data will only be processed until the participant's consent to data processing is revoked or until the competition has been processed and documented, but no longer than 5 years after the end of the calendar year in which the submission deadline has expired.
(12) The organizer may entrust the processing of the participant's personal data to another company on the basis of an agreement concluded in accordance with Article 28 of the RODO, in particular the data may be entrusted to companies that provide services for the organizer in the field of implementation and management of the competition as well as the maintenance of the IT service in which they are processed.
(13) The participant has the right to complain to the supervisory authority (UODO) if he considers that the processing of his personal data violates the provisions of the General Data Protection Regulation (RODO) as well as applicable data protection laws.
(14) To exercise your right to control your data, access the content of your data, correct your data and other rights, please contact the organizer.
§8 [Final Provisions].
1. The regulations are available on the website www.jobobike.pl.
2. The Facebook service and the Instagram service must be held harmless by each participant.
3. The competition is in no way sponsored, endorsed or conducted by or associated with Facebook and Instagram.
4. Facebook and Instagram are not involved in running the competition.
(5) The organizer of the competition uses Facebook and Instagram to carry out the competition at his own risk.
(6) The competition is not a lottery within the meaning of the Gambling Act of November 19, 2009.
(7) In matters not regulated by these conditions of participation, the provisions of Polish law apply.
