Competition rules (“Competition”) under the name:

"Jobobike 5th Anniversary"

1. Organizer

The organizer of the competition (hereinafter referred to as the “Competition”) is Jobo Europe Spółka z ograniczoną odpowiedzialnością, located at Gromadzka 5, Sokołów, registered in the KRS business register maintained by the District Court for the capital city of Warsaw, XIV Commercial Division of the National Court Register, under number: 0000803371, REGON: 38368971400000, NIP: 534 260 29 28. Share capital: 3,000,000 PLN.

(hereinafter referred to as “Organizer”).

1.1 Participants in the competition (hereinafter referred to as “participants”) can only be natural, fully legally competent persons residing in Germany who have the following:

1. Permanent access to the Internet (a device with Internet access such as a computer, tablet, phone, etc.),

2. A standard web browser with support for cookies,

3. A personal account on Facebook/Instagram.

2. Employees of the Promoter and their immediate families are excluded from participating in the Competition, including ancestors, descendants, siblings, spouses, parents of spouses and persons in a legal guardianship relationship.

2. Conditions for participation in the Contest are:

- Fulfillment of the participant conditions mentioned in §2 [Wettbewerbsteilnehmer],

- Familiarity with the competition rules and acceptance of their conditions,

- Consent to the processing of personal data for the purpose of participating in the competition,

- Completion of the competition tasks described in §3 [Wettbewerbsregeln].

3. Consent to the processing of data for participation in the competition can be expressed in particular by actively participating in the competition and completing the competition task and thus confirming acceptance of the conditions of participation and willingness to participate.

4. The competition runs from July 26, 2024 to August 26, 2024.

5.Entries submitted after the competition period will not be considered.

6. The competition is carried out via the organizer's Facebook fan page with the name Jobobike de and the organizer's Instagram fan page with the name jobobike.de.

8. Each participant may only take part in the competition once.

9. By participating in the competition, the participant confirms that he is aware that winning a prize is not a matter of chance, but depends on the actions of the participant, including fulfilling the conditions of the competition and completing the competition task as well as winning the competition .

10. The organizer reserves the right to remove texts and photos that are generally considered offensive, violate the rights of third parties or legal provisions, contain commercial offers or pornographic content, offend religious feelings or violate the personal rights of others.

11. In the event of a violation of the above conditions, the organizer reserves the right to exclude the participant from the competition.

12. The winner of the competition will be selected by the organizer exclusively from those who meet the conditions set out in the rules.

13. Participation in the competition is tantamount to the participant's acceptance of the competition conditions set out in the rules.

4. Prizes

1. The organizer appoints a three-person competition jury who will monitor the proper conduct of the competition and select 16 winners.

2. The organizer selects the most creative competition entries that fulfill the competition tasks.

3. Competition prizes:

- 1 Jobobike Viva electric bike – 1 winner

- €100 discount code – 5 winners (redeemable in our online shop at www.jobobike.de)

- Cycling clothing – 10 winners

4. The competition results (names and/or nicknames of the winners) will be announced after the end of the competition, i.e. h. on August 29, 2024, published on the organizer's fan pages.

5. The winner must send a private message via Facebook Messenger or Instagram with contact details and a shipping address for the prize.

6. The winner cannot transfer his claim to the prize to third parties.

7. The prize cannot be exchanged for cash or substituted for other products.

8. To receive the prize, the participant must provide his or her name, email address and telephone number.

5th complaint

1. A Contestant has the right to lodge a complaint regarding the Contest within 14 days of the end of the Contest.

2. Complaints in written form must be sent to the organizer's address.

3. The date of the postmark is decisive for compliance with the deadline for submitting a complaint.

4. The complaint must contain the participant's details: name, address or email address and the reason for the complaint.

5. The organizer will process the complaints within 14 days from the date of receipt.

6. The participant will be notified of the resolution of the complaint by mail to the address provided in the complaint submission.

6. Copyright

1. By participating in the competition, the participant declares that his/her competition contribution, i.e. h. the answer to the competition question, is exclusively his own work and does not infringe the copyrights or property rights of third parties.

2. The participant is fully responsible for all claims asserted by third parties in relation to the competition entry submitted by them.

3. The Participant transfers to the Organizer all ownership rights in the Work, including the Competition Entry submitted to participate in the Competition.

4. The organizer reserves the right to use and publish the competition entries submitted by the participants without temporal or spatial restrictions and to use them in all the areas of exploitation listed in Article 50 of the Law of February 4, 1994 on copyright and related rights without additional remuneration to use.

7. Personal Information. GDPR

1. The organizer is responsible for the personal data of participants.

2. The processing of participants' personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data, on the free movement of such data and repealing Directive 95/ 46/EC (hereinafter: GDPR).

3. The participants' data is processed on the basis of their voluntary consent for the purpose of participating in the competition.

4. For the purpose of participating in the competition, the organizer processes participant data such as first and last name, home address and telephone number.

5. In order to deliver and pay out the prize, the organizer is entitled to process the winner's data, including: first and last name, email address and telephone number.

6. Participants have the right to access their data, correct it, restrict its processing and object to the processing of their personal data for marketing purposes or their transfer to another data controller.

7. Participants have the right to data portability if the processing is automated, as well as the right to be forgotten (deletion of data), unless other legal provisions require the organizer to archive the data for the specified period.

8. Personal data is collected directly from the data subject.

9. Providing personal data is voluntary, but required to participate in the competition.

10. Participants can revoke their consent to the processing of their personal data at any time. Such a decision means that they are eliminated from the competition. Participants can revoke their consent at any time by informing the organizer.

11. The personal data of the participants will only be processed until the consent is revoked or until the competition is processed and documented, but not longer than 5 years after the end of the calendar year in which the deadline for paying the tax has expired.

12. The organizer may entrust the processing of participants' personal data to another body on the basis of a contract concluded in accordance with Article 28 GDPR. In particular, the data may be entrusted to entities that provide the organizer with services related to the administration and operation of the competition and the maintenance of the IT service in which the data is processed.

13. Participants have the right to lodge a complaint with the supervisory authority (UODO) if they consider that the processing of their personal data violates the provisions of the General Data Protection Regulation (GDPR) or other applicable data protection laws.

14. To exercise the rights of data control, access to data content, correction and other rights, participants should contact the Organizer.

8. Final provisions

1. The rules are available on the website www.jobobike.de.

2. Facebook and Instagram are exempt from any liability by each participant.

3. The competition is in no way sponsored, endorsed or administered by or affiliated with Facebook or Instagram.

4. Facebook and Instagram do not support the implementation of the competition.

5. The organizer of the competition uses Facebook and Instagram to carry out the campaign at his own risk.

6. The competition is not a lottery within the meaning of the Gambling Act of November 19, 2009.

7. German law applies to matters not covered by these rules.
